·      All products are subject to stock availability

·      We reserve the right to cancel or refuse orders including but not limited to accidental price glitch or payment glitch, frequent returns without purchasing, insufficient address or orders placed from places without delivery services available.

·      Prices may change without notice

·      Errors in pricing or descriptions may be corrected

·      Due to the handmade nature of our products, each item is unique. Variations in design, colour, size, and finish may occur from piece to piece and between batches. Such differences shall not be considered defects.

·      We try to display product images as true to the real product as possible but there is still possibility that the product received may be slightly different from the product images due to the camera settings, angles, lighting, etc.

·      We do not provide any guarantees or warranties regarding normal wear and tear of products. This includes but is not limited to colour fading, loss of embellishments, zipper failure, fabric snagging or any other issues arising from regular use.

5.   Payments

·      Payments must be made through the approved methods

·      You agree to provide valid payment details

·      We are not responsible for third-party payment failures

6.   Shipping and Delivery

·      Delivery timelines are estimates and may change

·      Delays may occur due to unforeseen circumstances

·      We shall not be liable for any delays, failed deliveries or damages caused during transit by third -party delivery partners

·      Risk of loss and title for products pass to the customer upon handing over shipments to the delivery partner

·      Customers are responsible for providing accurate shipping details. We are not liable for failed deliveries due to incorrect or incomplete addresses

·      Delivery shall be considered complete once proof of delivery is generated by the delivery partner

·      We shall assist customers in coordinating with delivery partners but are not responsible for their actions or service quality

·      In case of damaged or lost shipments, customers must notify us within 30 days. We will assist in raising claims with the delivery partner but do not guarantee resolution

8.   Intellectual Property

All content on this website including but not limited to text, images, logos, design, illustrations, software, code, icons, service marks, trade names, product names, products and ‘look and feel’ of the website is owned by or licensed to us. You may not:

·      Copy, reproduce, create derivative works from, sell, upload, post, republish, distribute or otherwise exploit any content on this website without our permission.

·      Use any website content to create any product, service or content that competes with the company.

·      Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of any software or technology used on this website.

·      Use our branding without our consent

9.   Limitation of Liability

10.                      Dispute Resolution and Arbitration

·      Any dispute, controversy, claim arising out of or relating to the use of the platform, transactions between users or the Company, or the interpretation, breach or termination of these terms, shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

·      The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, failing which appointed in accordance with the Act. However, such appointment shall be subject to applicable law and principles of neutrality and fairness.

·      The seat and venue of arbitration shall be New Delhi, India.

·      The language of arbitration shall be English.

·      The arbitral award shall be final and binding on all parties and may be enforced in any court of competent jurisdiction.

·      The costs of arbitration shall be borne as determined by the arbitrator.

·      Nothing in this clause shall prevent a consumer from seeking remedies under applicable consumer protection laws, including filing complaints before appropriate consumer forums.

·      The parties shall first attempt to resolve disputes through good faith negotiations within 30 days before initiating arbitration.

·      The parties agree that the arbitration proceedings and any award shall be kept confidential.

 

11.                      AI, Machine Learning, and Automated Use Restrictions

You may not, and may not permit any third party to:

 

·      Use, access, scrape, crawl, or collect any content, data, text, images, video, audio, or other material from the Site for the purpose of training, developing, testing, or improving any artificial intelligence system, machine learning model, large language model, or similar automated or algorithmic system.

·      Use any automated system, software, or process (including bots, scrapers, crawlers, spiders, or data mining tools) to extract, copy, or reproduce any content or data from the Site, except as the result of standard search engine indexing or as expressly permitted by us in writing.

·      Compile, aggregate, or create datasets from the Site's content, whether for commercial or non-commercial purposes, without our prior written consent.
